Establishment Agreement

AN AGREEMENT FOR THE ESTABLISHMENT OF A NATIONAL PARK ON BANKS ISLAND

AMONG:
THE GOVERNMENT OF CANADA ("Canada")
- and -
THE INUVIALUIT GAME COUNCIL, a Society duly incorporated pursuant to the Societies Act of the Northwest Territories ("IGC")
- and -
THE INUVIALUIT REGIONAL CORPORATION, a corporation incorporated pursuant to Part II of the Canada Companies Act ("IRC")
- and -
THE GOVERNMENT OF THE NORTHWEST TERRITORIES ("GNWT")

RECITALS

A. Canada wishes to create a National Park on Banks Island for the benefit, education and enjoyment of all Canadians and to add to Canada's world-renowned system of national parks.

B. The proposed park lies within the Western Arctic Region, as defined in the Western Arctic (Inuvialuit) Claims Settlement Act , S.C., 1984, c.24, proclaimed into force on July 25, 1984.

C. The Act gives effect to the terms of the Inuvialuit Final Agreement, dated June 5, 1984, entered into between the Committee for Original Peoples' Entitlement and Canada.

D. The Inuvialuit Final Agreement provides to the Inuvialuit certain rights and benefits within the Western Arctic Region.

E. The IGC represents the collective Inuvialuit interest in Wildlife.

F. The IRC has those responsibilities as set out in the Inuvialuit Final Agreement.

G. The purpose of this Agreement is to set forth the terms and conditions under which the Parties agree to the establishment of a National Park on Banks Island, consistent with those provisions of the National Parks Act and its regulations that are consistent with the provisions of the Inuvialuit Final Agreement.

Therefore, the Parties agree as follows:
